How to modify placement or custody orders if both parents agree

Custody and physical placement orders are easier to change when the parents agree on the changes. At any time, if parents agree on a change in custody or placement, they can file both:

• Stipulation to Change Legal Custody, Physical Placement
  • Under the AGREEMENTS section, you will be filling out section 4.
• Order on Stipulation to Change Legal Custody, Physical Placement
  • You just need to fill out the top section

To be legally binding, the agreement must be submitted to the court for approval. If the court doesn’t approve the agreement, the agreement is not an order, and the parents aren’t required to follow it. However, the court will usually approve the agreement unless it finds that the agreement isn’t in the best interests of the child.
